Important Information When Adopting Your Foster Child in West Virginia...

If you have a foster child through the WV Department of Human Services, or through a WV childcare agency, you should know that WV adoption attorney Robert T. Noone NEVER charges a fee to discuss the adoption of a foster child or a child in kinship care. We represent foster parents STATEWIDE, and you never pay for our transportation. In fact, if the WV DHS is paying you an adoption subsidy, you do NOT pay us a penny to represent you in the adoption!. In most instances, we even pay your filing fee of $208 per child for you.

We have handled the adoption of WV foster children for over four decades now all over the state, and it is one of our favorite legal proceedings – as children are often removed from neglectful homes and placed with a forever family they have bonded with over the course of the legal hearings where the parental rights are terminated.

If you are serving as a foster parent or kinship placement and a child is placed with you by the Department (DHS) or by a child care agency, chances are you will have NO legal fees involved in the adoption. We handle all the paper work, hearing preparation and work closely with the social worker assigned to your case to move the case as promptly as possible to final hearing.

Most of the children that are in foster care as a result of mistreatment or a parent's drug use qualify for a subsidized legal adoption, meaning that you will continue to receive benefits after the adoption, as well as medical care for that child. Those documents are obtained and made a part of the final order in your case to insure the benefits for you and your child until they reach the age of majority.

Adoption

Adoption is the process whereby a person legally becomes the parent and guardian of a child born to someone else. The adopting parent is legally responsible for the financial, emotional, and physical care of the child.

Foster Care

If parents are unable or unwilling to care for their children and a family member or friend does not step forward to help, children are placed into protective custody. This is known as “foster care.”

Guardianships

If parents have not named temporary guardians in a power of attorney or stand by guardianship document and they become incapacitated and cannot take care of their children, the court must step in and appoint a guardian. In addition, if a guardian is not named in a will, the court must also step in and appoint a guardian. These court proceedings are called guardianship proceedings.
